1. Acceptance of Terms
By accessing and using the services provided by Deficundea Solar ("Company," "we," "our," or "us"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Description of Services
Deficundea Solar provides solar panel installation, maintenance, and related renewable energy services throughout the United Kingdom. Our services include:
- Solar panel system design and installation
- Battery storage system installation
- System maintenance and monitoring
- Energy efficiency consultations
- Warranty and support services
3. Quotations and Estimates
3.1 Quotation Validity
All quotations are valid for 30 days from the date of issue unless otherwise specified. Prices may be subject to change based on site conditions discovered during the survey or changes in material costs.
3.2 Site Survey
A comprehensive site survey will be conducted before installation. If site conditions differ significantly from the initial assessment, we reserve the right to adjust pricing accordingly.
4. Payment Terms
4.1 Payment Schedule
Payment terms will be specified in your individual service agreement. Typically:
- 10% deposit upon contract signing
- 40% upon delivery of materials
- 50% upon completion of installation
4.2 Late Payment
Late payments may incur interest charges at a rate of 1.5% per month or the maximum allowed by law, whichever is lower.
5. Installation Process
5.1 Access Requirements
Customer must provide reasonable access to the property for survey, installation, and maintenance purposes. This includes:
- Clear access to roof areas
- Access to electrical systems
- Adequate parking for installation vehicles
- Removal of personal items from work areas
5.2 Installation Timeline
Installation timelines are estimates and may be subject to weather conditions, permit delays, or unforeseen circumstances. We will notify customers of any significant delays.
6. Warranties and Guarantees
6.1 Product Warranties
Solar panels and equipment come with manufacturer warranties as follows:
- Solar panels: 25-year performance warranty
- Inverters: 10-year manufacturer warranty
- Battery systems: 10-year warranty (varies by manufacturer)
6.2 Installation Warranty
We provide a 10-year warranty on our installation workmanship, covering:
- Roof penetrations and weatherproofing
- Electrical connections and wiring
- Mounting system integrity
6.3 Performance Guarantee
We guarantee that your solar system will generate at least 90% of the estimated annual energy production in the first year, subject to normal weather conditions.
7. Customer Responsibilities
Customers are responsible for:
- Obtaining necessary permits and approvals (where not included in our service)
- Maintaining clear access to the solar system
- Promptly reporting any system issues
- Performing basic system monitoring
- Not attempting unauthorized modifications to the system
- Ensuring property insurance covers the solar installation
8. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim shall not exceed the total amount paid by the customer for our services
- We are not liable for indirect, consequential, or incidental damages
- We are not responsible for performance issues caused by factors beyond our control (weather, grid outages, etc.)
- Our liability for delays in installation is limited to direct costs only
9. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, or severe weather
- Government actions, regulations, or permit delays
- Labor disputes or material shortages
- Pandemics or health emergencies
- Utility company delays or requirements
10. Cancellation and Refunds
10.1 Cooling-off Period
Residential customers have a 14-day cooling-off period from contract signing to cancel without penalty, subject to the Consumer Contracts Regulations 2013.
10.2 Cancellation by Customer
If installation has begun, cancellation may result in charges for:
- Materials ordered or delivered
- Work completed to date
- Permit and design costs
- Restocking fees for returned materials
10.3 Cancellation by Company
We may cancel this agreement if:
- Customer fails to make required payments
- Site conditions make installation unsafe or impossible
- Necessary permits cannot be obtained
- Customer breaches these Terms
11. Maintenance and Service
11.1 Maintenance Requirements
While solar systems require minimal maintenance, we recommend:
- Annual system performance review
- Periodic cleaning of panels (as needed)
- Inverter monitoring and maintenance
- Battery system maintenance (if applicable)
11.2 Service Response
For warranty claims or service requests:
- Emergency issues: 24-48 hour response
- Non-emergency issues: 5-10 business day response
- Routine maintenance: Scheduled by appointment
12. Insurance and Safety
12.1 Our Insurance
We maintain comprehensive insurance coverage including:
- Public liability insurance (£2 million minimum)
- Professional indemnity insurance
- Employer's liability insurance
- Product liability insurance
12.2 Customer Insurance
Customers must inform their home insurance provider of the solar installation and ensure adequate coverage for the system value.
13. Compliance and Regulations
All installations comply with:
- Building Regulations and Planning Permission requirements
- IET Wiring Regulations (BS 7671)
- MCS (Microgeneration Certification Scheme) standards
- DNO (Distribution Network Operator) requirements
- Health and Safety regulations
14. Intellectual Property
All system designs, documentation, and proprietary information remain the intellectual property of Deficundea Solar. Customers receive a non-exclusive license to use system documentation for their installed system only.
15. Data Protection
We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws. Customer data will be used for service provision, support, and legitimate business purposes only.
16. Dispute Resolution
16.1 Informal Resolution
We encourage customers to first contact us directly to resolve any disputes or concerns.
16.2 Alternative Dispute Resolution
If direct resolution is not possible, disputes may be referred to:
- MCS complaints procedure
- RECC (Renewable Energy Consumer Code) dispute resolution
- Trading Standards mediation services
16.3 Governing Law
These Terms are governed by English law, and any disputes will be subject to the exclusive jurisdiction of English courts.
17. Modifications to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date. Continued use of our services after such modifications constitutes acceptance of the updated Terms.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
